1. Acceptance of Terms
By accessing or using the IgnisCompetence platform ("Platform"), you ("Customer", "you", or "your") agree to be bound by these Terms of Service ("Terms"). If you are using the Platform on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
If you do not agree to these Terms, you must not access or use the Platform.
2. Service Description
IgnisCompetence is a training and competence management platform designed for fire and rescue services. The Platform provides tools for recording training activity, managing assessments, tracking qualifications, conducting internal quality assurance (IQA), running tabletop exercises, and generating compliance reports.
We may update, modify, or discontinue features of the Platform from time to time. We will endeavour to provide reasonable notice of material changes.
3. Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Ensuring all users within your organisation comply with these Terms
- Notifying us promptly of any unauthorised use of your account
You must not share login credentials or allow multiple individuals to use a single account simultaneously.
4. Subscription & Payment
Access to certain features of the Platform is subject to a paid subscription. Subscription fees, billing cycles, and payment terms are set out in your order or service agreement.
Failure to pay subscription fees may result in suspension or termination of your access to the Platform. All fees are exclusive of VAT or other applicable taxes unless stated otherwise.
5. Intellectual Property & Ownership
5.1 Platform Intellectual Property
All intellectual property rights in and to the IgnisCompetence platform, including but not limited to:
- software, source code, object code, and system architecture
- workflows, logic, data structures, and configuration models
- user interface design, layouts, and visual elements
- AI prompts, models, outputs, and system-generated logic
- documentation, reports, dashboards, and analytics
- trademarks, logos, and branding
are and shall remain the exclusive property of IgnisCompetence Ltd (or the operating entity), unless expressly stated otherwise.
No rights, title, or interest are transferred to the Customer except for the limited licence expressly granted under these Terms.
5.2 Licence to Use
Subject to payment of applicable fees and compliance with these Terms, IgnisCompetence grants the Customer a non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the platform solely for the Customer's internal fire service operations during the term of the agreement.
The Customer shall not:
- copy, modify, or create derivative works of the platform
- reverse engineer, decompile, or attempt to extract source code
- replicate or reproduce platform functionality in whole or in part
- provide access to the platform to third parties outside the organisation
5.3 Customer Data Ownership
All data, content, records, documents, and evidence uploaded to or generated within the platform by the Customer ("Customer Data") remain the property of the Customer.
IgnisCompetence does not claim ownership over Customer Data.
The Customer grants IgnisCompetence a limited licence to host, process, analyse, and display Customer Data solely for the purpose of providing and improving the services, including generating AI-assisted insights and reports.
5.4 Aggregated & Anonymised Data
IgnisCompetence may collect, use, and retain aggregated and anonymised data derived from Customer usage of the platform for the purposes of:
- system improvement and optimisation
- development of new features and services
- analytics, benchmarking, and industry insights
Such data shall not identify the Customer, any individual, or any specific site.
5.5 AI-Generated Content & Outputs
Any AI-generated outputs (including training summaries, assessment write-ups, recommendations, insights, or scenario content) are provided as decision-support tools.
Ownership of AI-generated outputs created specifically from Customer Data belongs to the Customer. However, the underlying AI systems, prompts, logic, and generation methods remain the intellectual property of IgnisCompetence.
5.6 Feedback & Suggestions
Any feedback, suggestions, or improvement ideas provided by the Customer may be used by IgnisCompetence without restriction or obligation, and shall not be considered confidential or proprietary to the Customer.
5.7 Protection Against Imitation
The Customer shall not use access to the platform to:
- benchmark, analyse, or replicate IgnisCompetence functionality
- develop or assist in the development of a competing system
- share platform designs, workflows, or logic with third-party vendors
6. Data Protection & Privacy
Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms. By using the Platform, you agree to our Privacy Policy.
Where IgnisCompetence processes personal data on behalf of the Customer as a data processor, the terms of the applicable Data Processing Agreement shall apply.
7. Acceptable Use
You agree not to use the Platform to:
- upload or transmit any unlawful, harmful, or fraudulent content
- attempt to gain unauthorised access to other accounts or systems
- introduce viruses, malware, or other harmful code
- use the Platform in any way that violates applicable laws or regulations
- circumvent any security or access control measures
8. Limitation of Liability
To the maximum extent permitted by applicable law, IgnisCompetence shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Platform.
Our total liability to you for any claim arising under these Terms shall not exceed the fees paid by you in the twelve (12) months preceding the claim.
AI-generated outputs are provided as decision-support tools only. IgnisCompetence accepts no liability for decisions made on the basis of AI-generated content.
9. Availability & Uptime
We endeavour to maintain high availability of the Platform but do not guarantee uninterrupted access. Planned maintenance will be communicated in advance where possible. We accept no liability for service interruptions outside our reasonable control.
10. Termination
Either party may terminate access to the Platform in accordance with the terms of the applicable subscription or service agreement.
On termination, the Customer's right to access the Platform ceases immediately. We will retain Customer Data for a period of 30 days following termination, during which the Customer may request an export. After this period, data may be permanently deleted.
11. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via the Platform or by email. Your continued use of the Platform following notification constitutes acceptance of the updated Terms.
